Foreign retirement accounts are a continuous source of complexity for multinational clients. Based on Internal Revenue Code specificity re: qualification of a retirement asset for tax-advantaged status, virtually all foreign retirement accounts do not meet American qualified plan standards. Resultantly, American statutory tax/reporting requirements are severe - but can be drastically reduced/eliminated where tax treaty coverage exists. In this program, we'll cover typical structures of foreign retirement accounts and their American tax consequences. We'll also address treaty coverage - and significant alterations to statutory rules provided in Rev. Proc. 2020-17.
